REGULATION OF THE CITIZENS’ LABOR RIGHTS PROTECTION LEAGUE

1. GENERAL CONCEPTS

1.1. The Citizens’ Labor Rights Protection League (further CLRPL) is non-political, non-commercial and non-governmental organization and acts on the ground of Azerbaijan Republic’s Constitution, Azerbaijan Republic’s Law on “Public Unions” and this regulation.

1.2. CLRPL is created on the basis of volunteer union of citizens of Azerbaijan Republic and acts upon democratic principles.

1.3. CLRPL is a juridical person, it has round seal, stamp, firm form, emblem, manat and currency account, other  properties.

2. CLRPL GOALS AND DUTIES, ACTIVITY PRINCIPLES.

2.1. Major goal of CLRPL is to assist to establishment of labor relations, suitable to national legislation and international norms, between employees and employers and to conduct an enlightenment work  in this field. CLRPL, in its activity, renders legal, organizational and methodical aid to trade unions.

CLRPL does not deal with exact activity including competence of trade unions.

  • In order to realize purposes shown above CLRPL implements following duties:
  • Conducts education work on labor right among citizens;
  • Prepares information and reports on general situation of citizens’ labor rights and delivers to the public and interested organs;
  • Deals with other activity appropriate to legislation and this regulation.

3. MEMBERSHIP in CLRPL. RIGHTS AND DUTIES OF MEMBERS

3.1. There is an individual and collective membership in CLRPL.

-Everyone, who saw and adopted regulation of CLRPL, living in Azerbaijan Republic, may apply to CLRPL organs and be individual member of it.
-Non-governmental and non-political organizations, activities of which are not contradictory to CLRPL regulation and principles, may become collective member of CLRPL. For this a decision of head organ of that organization and appeal are necessary.

3.2. CLRPL members have following rights:

  • To take part in all arrangements of CLRPL, to elect and be elected to its elective organs.
  • To use CLRPL legal service while violation of their labor and social rights.
  • To say open ideas on CLRPL activity.

3.3. Besides rights shown above, CLRPL’s collective members are enabled to appoint one plenipotentiary representative to CLRPL executive committee.

3.4. Duties of CLRPL members:

  • To observe regulation and decisions of CLRPL organs;
  • To take an active part in CLRPL actions.

3.5. CLRPL membership is over in following cases:

  • While organization is repealed;
  • While member leaves organization voluntarily;
  • While member is taken away from membership.

Removal from membership is conducted only in a case of serious regulation offence, by absolute decision of Executive Committee.

4. CLRPL ELECTIVE ORGANS, THEIR ESTABLISHMENT AND RULES OF DISSOLUTION. AUTHORITIES

4.1. Supreme organ of CLRPL is general meeting or conference which is summoned once in 2 years. By joint decision of executive committee and control commission or demand of  more than a half of members an early general meeting or conference may be called.

4.2. General meeting or conference solves following issues:

  • Listens to report of chair of executive committee on executive committee’s activity and evaluates;
  • Listens to report of control commission and evaluates;
  • Adopts regulation, makes additions and amendments to it;
  • Elects elective members of executive committee and control commission;
  • Adopts a decision on repeal of organization’s activity and determination of tale of its property;
  • Adopts other decisions suitable to legislation and regulation.

4.3. General meeting is authoritative only while more than a half of members is present, conference is authoritative while 2/3 of representatives is present. General meeting and conference determines itself voting rule. For adoption of decisions vote of more than a half of participants is demanded. For adoption of decision on repeal of organization and determination of fate of property, vote of 2/3 of participants of meeting and conference  is needed.

4.4. Within a period between general meetings or conferences CLRPL activity is headed by Executive committee.

4.5. Composition of executive committee is elected for 2 years at general meeting or conference of CLRPL. Collective members appoint its representatives to executive committee.

4.6. On the initiative of more than a half of members, an early meeting or conference may be held. Elected members of executive committee may be called back and it is implemented by organization that appointed it.

4.7. Powers of executive committee are followings:

  • Manages general activity of CLRPL;
  • Determines major directions of CLRPL activity;
  • Gives declarations on behalf of CLRPL;
  • Elects chair of executive committee and listens to its report;
  • Confirms contracts signed by chair of executive committee of CLRPL, also documents on cooperation with other organizations and membership.

4.8. Meetings of executive committee are called in case of necessity, but not later than once in 2 months, by chair of executive committee. An early meeting may be called on demand of half of members of executive committee or control organ.  Meeting is considered powerful when more than a half of members of executive committee is present. Executive committee determines itself rule for voting. For adoption of decisions, vote of more than a half of participants is demanded.

4.9. Executive committee elects its chair among its members.

Chair of executive committee manages financial-housing activity of CLRPL, organize its apparatus, determines staff table and represents it at other organizations.

4.10. Power period of chair of executive committee is the same with of elected members of  executive committee.

Chair of executive committee may early be called back  by  2/3 votes of members of executive committee.

4.11. In absence of chair of executive committee, one of members of executive committee substitutes him by decision of committee.

5. CLRPL’s CONTROL COMMISSION

5.1. CLRPL’s control commission is elected at general meeting for 2 years.  An early meeting may call back control commission early.

5.2. Control commission controls all organs of CLRPL.

5.3. Meetings of control commission are chaired by one of members in turn.

6. CLRPL RESOURCE AND PROPERTY. ITS CREATION SOURCES.

6.1. CLRPL property and financial resource is collected due to membership fees, voluntary donations of separate persons and foundations.

6.2. Monthly membership fee is determined, for individual members, in amount of 1/10 of minimum wage in Republic, for collective members in amount of minimum wage.

7. CLRPL’s INTERNATIONAL CONTACTS

7.1. CLRPL, according to legislation and regulation, cooperates with international organizations.

8. ADOPTION OF CLRPL’s REGULATION, MAKING ADDITIONS AND CHANGES TO IT. REPEAL OF CLRPL ACTIVITY AND FATE OF ITS PROPERTY.

8.1. CLRPL’s Regulation is adopted at general meeting or conference. Additions and changes to Regulation are made by general meeting or conference, too.

8.2. CLRPL activity may be repealed at its meeting. Decision is adopted by 2/3 votes of meeting participants.

8.3. Organ, repealing activity of CLRPL, makes decision on fate of its property. In case of repeal of organization its property and financial resources are, by decision of general meeting or conference, given to  one of non-governmental organizations activity and goals of which are suitable to of CLRPL.
