Monitoring and “Legal assistance day” was organized at the Penitentiary No. 12 of the Penitentiary Service

The Citizens’ Labor Rights Protection League conducted monitoring and “Legal assistance day” at the Penitentiary No. 12 of the Penitentiary Service on February 16, 2013.

4 lawyers participated at the monitoring and provision of legal assistance.

The reason for conducting the monitoring and provision of legal assistance was the appeal of prisoners detained at the Penitentiary No. 12 to the President and other related agencies through mass media. Prisoners claimed torture and bad treatment cases, corruption and negligent medical care at the penitentiary where they are detained.

All parts of the penitentiary, including cells and bodies of prisoners subject to tortures were inspected during the monitoring.

More than 40 persons involved to confidential interviews stated that there were bad treatment and cases of beating at the penitentiary. The prisoners also provided information about cases of corruption and negligent medical care.

There were noted signs of scar, bruising and tumor during the inspection of the prisoners’ bodies.

The administration linked it with application of force. During the inspection to registers on application of force and the prisoners’ bodies, the application of non-proportional force had been defined.

Corruption facts and negligent medical had also found its confirmation.

51 out of over 100 prisoners who asked for legal assistance were provided with legal assistance during the day (the rest will be provided with legal assistance later, because of time limits).

There was prepared a confidential report which covered all violation cases to the Minister of Justice. The report was consisted of the recommendations too.

Urgent visit of the National Preventive Mechanism and establishment of a special investigation commission had been suggested.

There will be addressed an application to the head of the National Preventive Mechanism for visiting the penitentiary in upcoming days.

Measures will be taken regarding punishment of persons who applied inadequate force.
